By accessing or using Nafago, you agree to comply with these Terms.
Nafago is a digital food delivery and commerce platform operating in Conakry, Guinea, connecting customers, restaurants, merchants, and delivery partners.
1. Definitions
- “Nafago” refers to the Nafago platform, its owners, operators, affiliates, and authorized representatives.
- “User” refers to any customer accessing or using the Platform.
- “Merchant” refers to restaurants, stores, supermarkets, or service providers listed on Nafago.
- “Delivery Partner” refers to independent riders or logistics personnel providing delivery services.
- “Services” refers to ordering, delivery, payments, customer support, and related platform services.
2. Eligibility
By using Nafago, you confirm that:
- You are legally capable of entering into binding agreements.
- The information provided during registration is accurate and complete.
- You will use the Platform only for lawful purposes.
Nafago reserves the right to suspend or terminate accounts providing false information or violating these Terms.
3. Account Registration
Users may be required to create an account to access certain features.
You are responsible for:
- Maintaining confidentiality of your account credentials
- All activities conducted through your account
- Updating your account information when necessary
Nafago is not responsible for unauthorized access caused by your negligence.
4. Services Offered
Nafago provides a technology platform that enables:
- Food ordering and delivery
- Grocery and consumer goods delivery
- Merchant discovery
- Delivery tracking
- Digital payment processing
- Promotional offers and discounts
Nafago acts only as an intermediary platform between users, merchants, and delivery partners.
5. Orders and Deliveries
Order Acceptance
All orders placed through the Platform are subject to acceptance and availability by the merchant.
Merchants may reject or cancel orders due to:
- Product unavailability
- Technical issues
- Pricing errors
- Service area limitations
- Operational issues
Delivery Time
Estimated delivery times displayed on the Platform are approximate and may vary depending on:
- Traffic conditions
- Weather conditions
- Restaurant preparation time
- Delivery distance
- Operational demand
Nafago does not guarantee exact delivery times.
Delivery Responsibility
Users must provide accurate delivery details.
If delivery fails due to incorrect information, unavailability, or lack of response from the user, the order may be cancelled without refund eligibility.
6. Pricing and Payments
Prices displayed on Nafago are provided by merchants and may include:
- Product pricing
- Delivery fees
- Platform service fees
- Packaging charges
- Applicable taxes
Payment methods may include:
- Mobile money
- Debit or credit cards
- Bank payments
- Cash on delivery (where available)
Users agree to pay all charges associated with their orders.
Nafago reserves the right to modify pricing, delivery fees, or service charges at any time.
7. Refunds and Cancellations
Refunds and cancellations are subject to Nafago's Refund and Cancellation Policy.
Refund requests may be approved in situations including:
- Failed payments
- Non-delivery of orders
- Incorrect orders
- Duplicate transactions
- Cancelled orders by merchants
Refund processing times may vary depending on payment providers and financial institutions.
8. User Conduct
Users agree not to:
- Use the Platform for unlawful purposes
- Abuse merchants, riders, or customer support staff
- Provide false information
- Interfere with Platform operations
- Attempt unauthorized access to systems
- Upload harmful software or malicious code
- Engage in fraudulent transactions
Nafago reserves the right to suspend accounts violating these Terms.
9. Merchant Responsibilities
Merchants are solely responsible for:
- Product quality
- Food preparation
- Pricing accuracy
- Hygiene and safety standards
- Compliance with local laws and regulations
Nafago does not manufacture, prepare, or inspect products sold by merchants.
10. Delivery Partner Responsibilities
Delivery partners operate as independent service providers.
Delivery partners are responsible for:
- Timely deliveries
- Maintaining professional conduct
- Compliance with road and transport regulations
- Safe handling of customer orders
Nafago may suspend or terminate delivery partner access for misconduct or repeated service failures.
11. Promotions and Discounts
Nafago may offer:
- Promo codes
- Discounts
- Loyalty rewards
- Referral programs
- Limited-time campaigns
Promotions may be modified, suspended, or cancelled without prior notice.
Promotional offers cannot be exchanged for cash unless explicitly stated.
12. Intellectual Property
All content on the Platform including:
- Logos
- Branding
- Software
- Designs
- Text
- Images
- Graphics
are owned or licensed by Nafago and protected under applicable intellectual property laws.
Users may not copy, reproduce, or distribute Platform content without written permission.
13. Limitation of Liability
Nafago provides the Platform on an “as available” basis.
To the maximum extent permitted by law, Nafago shall not be liable for:
- Delays in delivery
- Merchant product quality issues
- Service interruptions
- Technical errors
- Indirect or consequential damages
- Losses caused by third-party payment providers
- Force majeure events
Nafago's role is limited to facilitating interactions between users, merchants, and delivery partners.
14. Third-Party Services
The Platform may integrate third-party services including:
- Mobile money providers
- Payment gateways
- Maps and navigation services
- SMS and notification providers
Nafago is not responsible for disruptions or issues caused by third-party providers.
15. Account Suspension and Termination
Nafago reserves the right to suspend or terminate accounts for:
- Fraudulent activity
- Violation of these Terms
- Abuse of the Platform
- Security risks
- Illegal activities
Users may also request account closure by contacting customer support.
16. Changes to Terms
Nafago may update these Terms from time to time.
Updated Terms will be published on the Platform with the revised effective date.
Continued use of the Platform after updates constitutes acceptance of the revised Terms.
17. Governing Law
These Terms shall be governed and interpreted in accordance with the laws and regulations applicable in the Republic of Guinea.
Any disputes arising from the use of the Platform shall be subject to the jurisdiction of the competent courts in Conakry, Guinea.
